Question:
I am married, I have Ghana passport, my spouse has a French passport and my kids have French passports. We want to move to the UK for my children to study. Aged 16 and 12. I also like to do some temporary work while they’re schooling. What visa would I require?
Answer: In order to enter and reside in the UK legally while your children are completing their education, you would be required to apply for a visa based on your spouses EU passports. The application requires your spouse to apply to “remain settled” in the UK based on EU Rights, normally by showing intention to work or start a business in the UK.
The application must be submitted a t he British High Commission in Accra. Once the application is processed, the applicant will receive a entry clearance for a year as the spouse of an EU passport holder. Either upon Entry in the UK, or at least before the expiry of this visa, a further application must be submitted where the EU National applies to “remain settled” in the UK along with their spouse as the dependant. A further 4 years will be granted in this respect. You will be allowed to work on the visa.
After the completion of 4 years on the EEA Family visa, the applicant will be allowed to apply for permanent residence and a further year in the UK will enable you to apply for permanent residence and a further year in the UK will enable you to apply for British citizenship.
